There is no fee to enter this Contest. The contest opens Friday, July 1st, 2022 at 12:00:01 AM (CST). Deadline to enter is September 31, 2022 at 11:59:59 PM (CST). There will be no deadline extensions. You may enter as many songs as you’d like, but it does not increase your chances of winning. Each entry requires a separate submission form. Only valid and public URL links are accepted, so please double-check URL links before entering. Daddy Rack Tennessee Straight Whiskey (hereby known as Daddy Rack) is not responsible for broken or otherwise invalid links and will not accept MP3 files directly. You may enter a variety of recording styles, including demos, worktapes and finished masters. You must also include a lyrics sheet. We require the song to be clearly audible in the recording. This is a song contest, based on lyrical and melodic values, not a singing contest. Songs will be evaluated based on lyrics, melody, and various other musical considerations. Songs WILL NOT be evaluated on recording quality, vocal prowess, or other similar values. We simply require that the recording clearly presents the song in its fullest light, includes the word “whiskey” at least four times and must be two minutes or more long. You may enter online only, via https://www.daddyrack.com/the-gold-rackord.

The Contest is open to songwriters or bands in Tennessee and Georgia who are 21 years of age and older only. Conflicts of interest: Employees and independent contractors of Daddy Rack and their immediate families, immediate families of the judges panel are not eligible to enter. In addition, immediate families of employees, contractors and judges panel cannot be a co-writer or producer on a song submitted. If a song is found to be in violation, Daddy Rack reserves the right to disqualify the submitted song and songwriter. By submitting, you are agreeing that you are the sole owner of the lyrics and music and that you are not employed by or affiliated with Daddy Rack. You represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 21 years of age or older; and (d) your entry to the Contest does not violate any applicable law or regulation. Entry of the Contest is void where prohibited. All levels of winners are notified by email address or phone. Finalists must be able to appear live in Nashville, Tennessee in September, 2022 (date TBC) at Bourbon Street Blues and Boogie Bar (220 Printers Alley, Nashville, TN 37201).

This Contest is a talent and skilled-based event. All entries are judged based on the merit of the overall songs (lyric & melody). All entries will be first screened by one or more members of the Daddy Rack staff. Songs will be posted/featured on DaddyRack.com and the Top 4 will be considered for live audition for the Gold Rackord. All contest entrants should stay informed of the selection process via DaddyRack.com site updates and by Following Daddy Rack on social media (Facebook, Twitter and Instagram). The 4 finalists are then required to come to Nashville to perform their song live in Nashville, Tennessee in September, 2022 at Bourbon Street Blues and Boogie Bar (220 Printers Alley, Nashville, TN 37201). The three runners up will be notified via e-mail and phone, and all results will be posted on DaddyRack.com and announced on social media. No entrants will be provided with scores or evaluations of their entries, it is not feasible due to the number of entries.

All finalists get the chance to perform their song LIVE in Nashville, Tennessee in front of Daddy Rack (J. Arthur Rackham) himself.

Daddy Rack will be authorized to use songs entered worldwide for promotional purposes. This includes all materials submitted from all entrants in conjunction with the Contest. Such materials include written text, files, images, photos, videos, songs, lyrics, poetry, sounds, musical works, works of authorship, remarks, suggestions, ideas, graphics, tags, hashtags, genres, splits, ownership splits, identifiable numbers, identifiable codes, songwriter name, personal identifiable information, copyright registration information, affiliated companies or individuals, rights holder, sampling, administrator, publisher, or any other materials (collectively, “Content”) that you display, upload, transfer, publish, or post to DaddyRack.com, whether public or private. If you choose to use a sample, you acknowledge that you have the express written permission, otherwise you breach the copyright of the original sound recording, of the composition and lyrics, and of the performances, such as a rhythm or guitar riff. By submitting any Content through the Contest, whether public or private, you hereby grant to us an exclusive license to use, stream, transmit, beam, store, publicly display, translate, reproduce, and distribute such Content, in any format, whether known or unknown, including the limited right to use your likeness, persona, logo, trademark, and right(s) of publicity for purposes of the Contest and Daddy Rack promotional materials. By entering the Contest, you represent and warrant that your entry is an original work and that the content does not violate the privacy rights, publicity rights, copyrights, trademarks, contract rights or any other rights of any person or business, or any other rights of any third party. You further agree to indemnify and hold Daddy Rack, contest judges and screeners, and all contest sponsors, their subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of any breach of your representations and warranties set forth above and/or if any part of the entry causes Daddy Rack to be liable to another. We are encouraging the song to reflect the spirit of the times with positive lyrics (it won’t hurt to use the name “Daddy Rack” either). Any songs that includes hate speech, terrorism, conflict of interest, etc., will be disqualified.

Other Rules & Regulations

By entering the contest through daddyrack.com/the-gold-rackord, you expressly agree to the Terms and Conditions and Privacy Policy listed on the Daddy Rack website, the contractual terms of which are incorporated herein by reference. To the extent that the terms of this Contest conflict with any other agreement, the terms of this Contest shall take priority. Daddy Rack reserves the right to disqualify any entry that does not meet the rules herein outlined. We expressly disclaim any warranty and we cannot guarantee and do not promise any specific results. In no event shall we be liable to you or any third party for any indirect, consequential, exemplary, incidental, statutory, special or punitive damages, including lost profit damages arising from your entry into the Contest. Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you. The online entry form and checkbox (indicating confirmation of Terms & Conditions) constitutes each song submitted as an original work and releases Daddy Rack Tennessee Straight Whiskey from all liability. By entering you also understand that your email address will be shared with contest sponsors.

The parties shall attempt in good faith to resolve any dispute arising out of or relating to this Agreement promptly by negotiation between persons who have authority to settle the controversy. Any party may give the other party written notice of any dispute not resolved in the normal course of business. If not resolved, any dispute, claim or controversy (i.e., contractual, tort, and/or statutory) arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined EXCLUSIVELY by arbitration in Nashville, Tennessee before one arbitrator. This Agreement and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the States of Tennessee and Georgia, exclusive of conflict or choice of law rules.

The Grand Prize will be delivered on the day of the live competition.

Win a bottle of Daddy Rack monthly social media competitions are open to entrants aged 18 and over who reside in England or Wales. Entries are accepted each month from ‘The Rack Pack UK’ sign up page (our UK mailing list). Winners will be chosen at random on the last day of each month. Prizes are not transferable and cannot be exchanged for a cash equivalent.

The promoter of the ‘Win a bottle’ UK monthly competitions is our UK Distributor, Emporia Brands Ltd (172 London Rd, Guildford GU11XR).

By entering this competition, entrants confirm they have read, understand and agree that these terms and Emporia Brands Privacy Policy (and the way we process personal data) are binding to them. Emporia Brands reserves the right to amend these terms; to hold void, suspend, cancel or amend this competition at any time.

This competition is only open to individual who are residents in England and are 18 years or older. Ineligible entries will be discarded. Emporia Brands reserves the right to verify the validity of entries and entrants, including an entrants identity, age and place of residence, at any time and reserve the right to disqualify any individual or any entry, it believes has breached any of these terms, tampered with the entry process or engaged in any unlawful or improper conduct which may undermine the fair and proper conduct of this competition.

The current February 2023 competition starts at 12pm Tuesday 7th February 2023 and will finish at 12am Sunday 12th February 2023.

To enter, no purchase necessary, individuals must follow our UK Facebook page and our UK Instagram page. You must be able to verify you are aged 18+ and will be undertaken by our UK Distributor Emporia Brands Ltd. They have the right to refuse the competition prize if they believe there is criminal activity or false identification. This is to avoid unlawful entries and unfair competition results.

The prize is a 70cl bottle of Daddy Rack Tennessee Straight Whiskey. A winner will be selected using a random generator on Monday 13th February 2023. The winner will be notified by email as soon as practicable. If the winner does not claim their prize within 10 days of Emporia Brands contacting them, Emporia Brands reserves the right to offer the prize to another eligible entrant. Emporia Brands cannot accept any responsibility if the winner is unable to take up the prize or fails to claim the prize within the time limit as set out above.

Insofar as is permitted by law, the promoter, its agents, employees, and/or representatives shall in no circumstances be responsible or liable to compensate any entrant who participates in the competition an/or the winner and their guest(s) who claim(s) the prize for any loss, damage, personal injury or death whatsoever and howsoever caused. Competition entrants’ statutory rights are not affected.
